This is an on-demand broadcast of a previously recorded presentation. Much is written on the topic of mediation and negotiation. Books, papers, CLE presentations, and articles abound, and much of what’s written is helpful, particularly for those relatively new to the mediation process. However, for regular practitioners – attorneys, mediators, and others who routinely mediate – little in the catalog of available materials offers specific guidance to meet specific challenges in real-world negotiations. 

That’s why we call this series, “The X’s and O’s of Mediation – A Real-World Negotiation Playbook.” Think of us as coaches in the locker room, not pundits in the booth. We’re not here to comment on how the game is played – we’re here to show you how to win.

On defense, we will examine obstacles to your success at mediation, and how they can be met, overcome, or avoided altogether. On offense, we will help you map and execute a winning strategy. Our instruction is not organized by chapters and paragraphs because mediation challenges and opportunities don’t come at you in chapters and paragraphs. 

We present each scenario in three parts: Situations, Options, and Solutions. We lay no claim to our solutions being exhaustive. There are often multiple ways to crack a nut. We show you the ones we know have worked in real mediation situations.

The only organizational concept we will accede to is temporal – these three units focus on what to do before, during and after the mediation process. Aristotle wrote, “Well begun is half done.” Not being ones to quibble with ancient wisdom, we thus start at the beginning.
